HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.13039 of 2015 O R D E R :

This criminal petition is filed by the petitioner - accused No.1, under sections 437 and 439 Cr.P.C., seeking bail in Crime No.89 of 2015-16 of Peddapuram Prohibition & Excise Police Station, East Godavari District, registered for the offences under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act, 1985.

The allegation is that 45 packets of ganja measuring 90 kgs was found in the possession of a car bearing No.AP 31 BA 5789 in which accused Nos.1 to 3 were travelling.

In this case, charge-sheet has already been filed and the same has been numbered as NDPS Sessions Case No.55 of 2015 on the file of the NDPS Act Designated Court (I Additional Sessions Judge), Rajahmundry. Considering the facts of the case, it is clear that there is prima facie case against the petitioner - accused No.1. Therefore, this Court is not inclined to grant bail to the petitioner - accused No.1.
