THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.32333 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners state that their father was an Ex-serviceman and was allotted a house site in T.S.No.935/1 of Kummarathopu, Tirupati Revenue Village, Chittoor District, wherein he construed a house bearing No.1-4-461. It is stated that the father of the petitioners died on 26.12.2009 and the petitioners as his legal heirs succeeded to the said property. However, the petitioners sought 'No Objection Certificate' as per G.O.Ms.No.307, dated 06.06.2013, from the District Collector, Chittoor District, the 2nd respondent, under application, dated 25.03.2015, Ex.P3, as they intend to take loans from the banks/financial institutions. Alleging inaction, the present Writ Petition is filed.

In the facts and circumstances of the case, since the petitioners application seeking 'No Objection Certificate' is stated to be pending with the 2nd respondent since 25.03.2015, it is just and appropriate to direct the 2nd respondent to consider the petitioners' request and pass appropriate orders, preferably within a period of six weeks from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. There shall be no order as to costs.
