THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.5727 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus to declare the action of the respondents in implementing the G.O.Ms.No.2 of Social Welfare Department dated 09.01.2004 with retrospective effect and reverting the petitioner to his previous post of line man from the rpesent post of line inspector as illegal, arbitrary and unconstitutional and consequently to suspend the proceedings of the first respondent in Memo No.DEE/O/MCL/ADM/JAO/C1/D No.1114/2004 dated 04.02.2004 reverting the petitioner from line inspector to line man and to up hold the proceedings of the first respondent in Memo No. DEE/O/MCL/ADM/JAO/C1/D No.681/03 dated 06.10.2003 by which the petitioner was promoted to the present post of line inspector from his previous post of line man and to pass such other necessary orders. At the time of hearing, learned counsel for the petitioner submitted that the purpose of filing the writ petition becomes infructuous.

In view of the submission made by the learned counsel for the petitioner the writ petition is dismissed as infructuous. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
