THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12262 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/A3 and A4 seeking anticipatory bail in the event of their arrest in connection with Crime No.345 of 2023 of LMD Colony Police Station, Karimnagar District, registered for the offence punishable under Section 307 of IPC.

Heard learned counsel for the petitioners/A3 and A4, learned Additional Public Prosecutor representing respondent No.1-State and perused the record.

The case of prosecution is that A1 and A2 attacked the victim on 22.10.2023 by going on a motorcycle, which did not have registration number. A1 stabbed the victim in the abdomen and thereafter they fled away from there. During the course of investigation, it was confessed by A1 and A2 that the petitioners/A3 and A4 also involved in the subject crime.

During the course of investigation, it is brought to the notice of this Court that A1 and A2 were granted relief of regular bail in Crl.M.P.No.319 of 2023 in the subject crime by the learned II Additional District Judge, Karimnagar.

Learned counsel for the petitioners would submit that except the confession made by A1 and A2, there is nothing on record to connect the petitioners with the alleged attempt to murder on the victim. 6.

According to the case of prosecution, A1 and A2 are the persons, who attacked the victim by going on a motorcyle. Therefore, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners/A3 and A4 subject to the following conditions:

1) The petitioners/A3 and A4 are directed to surrender before the Station House Officer, LMD Colony Police Station, Karimnagar District, within a period of seven days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A3 and A4 on bail, on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A3 and A4 shall appear before the concerned Station House Officer, on every Monday and Wednesday, for a period of four (4) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.

3) The petitioners/A3 and A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
