THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO FAMILY COURT APPEAL No.154 OF 2005 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal is filed aggrieved by the order and decree, dated 08.08.2005, passed in O.P.No.74 of 2004 by the Family Court, Kurnool, by which, the petition filed by the appellant, under Section 27 (1) (d) of Special Marriage Act, 1954 and Section 7 (1) (a) of Family Courts Act, 1984, seeking divorce by dissolving the marriage solemnized on 12.08.1989 between himself and the respondent, was dismissed.

When the matter is called, it is submitted by the learned counsel for appellant that during pendency of the appeal, parties have settled the matter and they are living together, and hence, the subject matter of this appeal has become infructuous.

Recording the same, the appeal is dismissed as infructuous. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. No costs.
