HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.44256 OF 2016 ORDER:
The writ petition is filed questioning the order dated 12.09.2014, passed by the 2nd respondent, rejecting the claim of the petitioner to be recognized as a Founder-Trustee Member in terms of Section 17 of the A.P. Charitable & Hindu Religious Institutions and Endowments Act, 1987 (for short, "the Act").
Though, various aspects were urged by the learned counsel for the petitioner, considering that there is an alternative effective remedy available under Section 87(1)(h) of the Act, the writ petition is closed giving liberty to the petitioner to approach the Endowment Tribunal by making appropriate application in accordance with the provisions of the Act. However, the petitioner shall be at liberty to urge all the contentions raised before this Court and the Endowment Tribunal shall consider the same and pass appropriate orders in accordance with the law. The petitioner shall also be given the benefit of Section 14 of the Limitation Act, for filing the application before the Endowment Tribunal. With the above observations, the writ petition is closed. No order as to costs.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
