HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29465 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the 1st respondent in not considering the petitioner's application dated 29.06.2016 in Form-VI(A) of the A.P. Record of Rights in Land and Pattadar Passbooks Rules, 1989 for mutating his name in the revenue records and issue Pattadar Passbook in respect of the land in Survey No. 106/ ID to an extent of Ac.150 cents, situated in 28 Gudesetti Palli village, Shantipuram Mandal, Chittoor district, as illegal, arbitrary and unconstitutional.

When the matter was taken up for hearing, the learned Government Pleader placed on record the written instructions received from the Tahsildar, Shantipuram, stating that the schedule land is standing in the name of Kommugattuveerappa, who is no more, and since the date of purchase, the legal heirs to the schedule land quarreled with each other and never cultivated the said land. It is stated that Kommu Muneppa and Kommu Venkatappa sold the schedule property, admeasuring 1.50 acres, to K.G.Ravichandra, who made an application for issuance of Pattadar Passbooks and Title Deeds after a period of five

years. It is stated that the petitioner has purchased the land from other persons, who are not legal heirs to the schedule property and do not have any right over the schedule property. However, since the application made by the petitioner under Form VI(A) of the A.P. Record of Rights in Land and Pattadar Passbooks Rules, 1989 is pending consideration, the concerned authorities shall deal with the same and pass appropriate orders thereon within a period of three to four weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. 3.

Having regard to the above, the present writ petition is disposed of with consent, at the admission stage. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
