THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39878 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the inaction of respondents 2 & 3 in not considering the petitioner's representation, dated 01.10.2016, to close the Rowdy Sheet No.745/2016, as illegal and arbitrary.
Heard and perused the material available on record. The case of the petitioner is that the petitioner is a document writer and wrote umpteen number of documents while performing his job and that the Station House Officer, Lalapet, registered five crimes in Crime No.267 of 2014 (C.C.No.106 of 2015), Crime No.339 of 2014 (C.C.No.107 of 2015), Crime No.340 of 2014 (C.C.No.108 of 2015), Crime No.341 of 2014 (C.C.No.109 of 2015) and Crime No.342 of 2014 (C.C.No.110 of 2015) under Sections 420, 447 & 506 read with 34 IPC and that all the cases arise out of single transaction and that the petitioner is not aware of the registration of the crime and the Station House Officer did not even enquired the petitioner under Section 41 Cr.P.C.
and did not even informed the petitioner with regard to the existence of the said crimes and the petitioner came to know about the said crimes only when the Station House Officer called him to the police station and granted bail to the petitioner. The de facto complainants in all the said crimes happened to purchase the property, for which the petitioner attested the document. The main grievance of the petitioner is that the 3rd respondent opened a Rowdy Sheet against the petitioner vide Rowdy Sheet No.745 of 2014.
The main contention raised by the learned counsel for the petitioner is that on the basis of the pendency of the five crimes, the 3rd respondent opened a rowdy sheet and calling the petitioner to the police
station every week. Aggrieved over the same, the petitioner has already made a representation to the 3rd respondent on 01.10.2016. Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 3rd respondent is directed to consider the representation of the petitioner, dated 01.10.2016, and dispose of the same, as expeditiously as possible, in accordance with law, preferably within a period of three (3) months from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 18th November, 2016 KL
