THE HON'BLE SRI JUSTICE R.KANTHA RAO CRIMINAL PETITION No.15396 of 2013 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. seeking anticipatory bail for the petitioner/A1 in Cr.No.54/2011 on the file of Chaitanyapuri Police Station, Cyberabad, registered for the offences punishable under sections 418, 420 and 422 r/w.Sec.120-B of IPC.

Heard the learned counsel appearing for the petitioner/A1 and the learned Additional Public Prosecutor, representing the State. Learned Additional Public Prosecutor submits that investigation in this case is completed and charge sheet is filed. It is alleged against the petitioner/accused that she mortgaged the property with the de facto complainant bank initially for obtaining loan and thereafter, contrary to the terms of the mortgage, sold the property to two individuals by name, Polasa Shailaja and Sriramoju Shravan Kumar, thereby cheated the bank.

In view of the aforesaid allegations, I am not inclined to grant anticipatory bail to the petitioner/A1, even though investigation in this case is completed and charge sheet is filed.
