HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29412 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus to declare the order passed by the 4th respondent in No. MUT/ 29/ 06/ 00118 of 2018, as illegal, arbitrary and unconstitutional.

It is represented by the learned Government Pleader that against the order impugned, an appeal would lie under Section 5(5) of the A.P. Record of Rights in Land and Pattadar Passbooks Act, which fact is not seriously disputed by the learned counsel for the petitioner.

Having regard to the above, the present writ petition is disposed of with consent, at the admission stage, directing the petitioner to file an appeal under the provisions of the A.P. Record of Rights in Land and Pattadar Passbooks Act. At this stage, the learned counsel for the petitioner would submit that there is every possibility of the unofficial respondents alienating the schedule property basing on the entries made in the revenue records. Hence, status quo obtaining as on today, in all respects, shall be maintained for a period of ten (10) days from today, enabling the petitioner to obtain appropriate orders, if any, from the appellate authority. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
