The Hon'ble Sri Justice C.V.Nagarjuna Reddy Civil Revision Petition No.4983 of 2018 Date: 31.08.2018 Between:

Smt.Akula (Tupakula) Jayakumari .. Petitioner and Pendurthy Yella Rao and another .. Respondents Counsel for the Petitioner :

Mr.ASC.Bose The Court made the following:

CVNR, J CRP.No.4983 of 2018 Dt: 31.08.2018 Order :

Feeling aggrieved by dismissal of IA.No.367 of 2013 in OS.No.148 of 2013 vide Order, dated 04-07-2018, by the I Additional Senior Civil Judge, Visakhapatnam, the plaintiff in the aforementioned suit filed this Civil Revision Petition (CRP). I have heard Mr.A.S.C.Bose, learned Counsel for the petitioner, and perused the record.

While dismissing the IA referred to above, the Court below has observed that the alleged allotment letter, based on which the petitioner filed the suit, neither contains any boundaries nor indicates the physical features of the petition schedule property and that therefore, it is not possible for the Advocate- Commissioner to note down the physical features.

Having carefully examined the reasons assigned by the Court below for dismissing the aforesaid IA, I do not find any error therein warranting interference of this Court in exercise of its supervisory jurisdiction under Article 227 of the Constitution of India. This CRP is, accordingly, dismissed.

As a sequel to dismissal of the CRP, IA.No.1 of 2018, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 31st August, 2018 lur
