HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.1871 of 2017 ORDER:

Aggrieved by the dismissal of an application for sending the suit promissory note and memorandum of deposit of title deed to the Department of Forensic Science, the defendant in a suit for recovery of money has come up with the above revision.

2. Heard Mr. K. Satyanarayana Murthy, learned counsel for the petitioner.

3. Admittedly, the petitioner's earlier application to send these very documents to a private Handwriting Expert was allowed. The Handwriting Expert filed an opinion, which was not in favour of the petitioner. Therefore, the petitioner took out a second application to send the documents to the Government Handwriting Expert. It was rightly rejected by the trial Court.

4. There cannot be repeated applications for sending suit documents for examination by different Handwriting Experts. The petitioner took a chance for sending the documents to a private expert. There is no guarantee that in the second attempt, an opinion in favour of the petitioner may come. It is better that the petitioner does not run the risk of a second opinion. It is open to the petitioner to seek summoning of the Handwriting expert of Truth Labs for examination. Therefore, the Civil Revision Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
