This Criminal Petition is filed under Section 439 (1) (B) of Cr.P.C. by the petitioner/Accused No.1 seeking to relax the condition of furnishing one surety of Government servant working within the limits of Medchal-Malkajgiri District to the satisfaction of VIII Metropolitan Magistrate, Medchal in Crl.M.P.No.379 of 2023 on the file of II Additional District & Sessions Judge, Medchal-Malkakgiri District.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is native of Pune and he barely knows any Government employee in this State to comply with the condition of furnishing one Government surety imposed by the learned Sessions Judge, as such, he seeks relaxation of the said condition. Further, learned counsel submits that the petitioner is abiding with all other conditions imposed by the learned Sessions Judge regularly. 4.
In the said circumstances of the case, this Court deems it appropriate to relax the condition of petitioner furnishing one
surety of Government servant from the Telangana State working within the limits of Medchal-Malkajgiri District to one local surety. 5.
Accordingly, the Criminal Petition is allowed relaxing the condition of petitioner furnishing one surety of Government servant working within the limits of Medchal-Malkajgiri District to one local surety. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
