SMT JUSTICE T. RAJANI CRIMINAL PETITION No.8809 of 2018 ORDER:

This petition is filed seeking for quash of the proceedings against the petitioners, who are A1 and A2, in C.C.No.1803 of 2017 on the file of Judicial First Class Magistrate at Tiruvuru, Krishna District. The offence alleged against the petitioners is under Section 420 read with 34 IPC. 2.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent, in spite of notice.

The case of the complainant is that the accused promised to provide job to him and collected Rs.2,00,000/ - and later cheated him. 4.

The counsel for the petitioners submits that previously also a crime was registered against the petitioners, but the said submission would only support the contents of the complaint.

This Court prima facie finds that the offence alleged against the petitioners is attracted. Hence, this Court considers that it is not a fit case to quash the proceedings against the petitioners. 6.

Accordingly, the criminal petition is dismissed. However, the request of the petitioners' counsel to dispense with the presence of the petitioners is considered and the Court below is directed not to insist upon the presence of the petitioners, unless it is required for the proceedings. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
