Smt V.Sireesha Rani, learned counsel representing Sri K.Ramesh Babu, learned counsel for the appellant, seeks permission of this Court to withdraw the Criminal Appeal, as the matter is settled outside the Court.

This appeal is filed by the complainant aggrieved by the acquittal recorded by the learned Principal Junior Civil Judge, Tanuku vide judgment, dated 13.02.2009, passed in C.C.No.480 of 2003 for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. Since the subject matter of the appeal is settled outside the Court, nothing survives for adjudication. Hence, permission to withdraw the Criminal Appeal is accorded.

Accordingly, the Criminal Appeal is dismissed as withdrawn. 4.

Miscellaneous petitions pending, if any, in this Criminal Appeal shall stand closed.
