Heard counsel for the petitioner and the Government Pleader for Civil Supplies for respondents.
2. A case under Section 6A of the Essential Commodities Act, 1955 (for short 'the Act') has been registered against the petitioner and certain pulses and other stock were seized from the petitioner's premises on 30.10.2015.
3. Petitioner contends that the proceedings under Section 6A of the Act are pending before the 2nd respondent and that the 2nd respondent is not disposing of the same, although more than three months period has elapsed.
4. The Government Pleader for Civil Supplies states that no order of interim disposal of seized stock had been made till date and he assured that the 2nd respondent would dispose of the case under Section 6A of the Act registered against the petitioner within two months from today.
5. In view of the said submission, the Writ Petition is disposed of directing the 2nd respondent to complete the proceedings under Section 6A of the Act initiated against the petitioner within two (02) months from today and pending disposal of the same, the respondents 2 and 3 shall not sell the seized stock. There shall be no order as to costs.
6. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
