HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.5229 of 2014 ORDER:

This writ petition is filed by the petitioner seeking a direction to the 2nd respondent to dispose of the appeal filed by her viz., Rc.No.K4/ATP/792/2006, dated 18.1.2007.

The case of the petitioner is as follows:

The petitioner was appointed as a dealer to Fair Price Shop No.11 at Chennampalli village, Bukkarayasamudram Mandal, Anantapuram District. While so, on 11.7.2004, a show cause notice was issued to the petitioner, for which she submitted an explanation. The 3rd respondent suspended the authorization of the petitioner pending enquiry, vide order dated 30.7.2004. Aggrieved by the same, the petitioner filed an appeal before the 2nd respondent. The 2nd respondent confirmed the interim order of the 3rd respondent. Subsequently, the 3rd respondent without conducting any enquiry cancelled the authorization of the petitioner vide order dated 23.12.2006. Aggrieved by the same, the petitioner filed an appeal before the 2nd respondent viz., Rc.No.K4/ATP/792/2006. But the said appeal has not been disposed of so far. Hence, the present writ petition is filed by the petitioner.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: "The 2nd respondent is directed to dispose of the appeal viz., Rc.No.K4/ATP/792/2006 as expeditiously as possible,

preferably, within a period of six months from the date of receipt of a copy of this order."

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 17th April, 2017 Nn
