THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.17624 of 2015 ORDER:

This writ petition is filed assailing the action of the Tahsildar, Komarolu, Markapuram Mandal, Prakasam District, in proposing to auction the petitioner's properties in Reddycherla Village of Komarolu Mandal, Prakasam District. It is admitted by the petitioner that litigation is pending between him and the Wakf Authorities before the Wakf Tribunal at Hyderabad in Appeal No.4 of 2013. In that view of the matter, it is for the petitioner to seek appropriate protection, if warranted, before the Tribunal and not by way of an independent proceeding instituted before this Court. The petitioner cannot parallelly pursue two remedies simultaneously. The writ petition is therefore dismissed leaving it open to the petitioner to approach the Wakf Tribunal at Hyderabad for appropriate relief in accordance with law.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
