HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31462 OF 2017 ORDER:
It is the case of the petitioner that he retired from service on 31.03.2014 as Jr.Manager (Code No.2514), GPCMS, Venkatapuram Branch, Bhadrachalam Division, Khammam District, after attaining the age of superannuation; that no charges/allegations were pending against the petitioner; and that after retirement the petitioner approached the respondents for retirement benefits i.e. gratuity, leave encashment and group linked service Insurance benefits and arrear bills from the respondent department and requested orally and also submitted representations on 20.07.2016, 17.08.2016 and 30.06.2017. But, the respondents did not consider the said representations and release the benefits. The petitioner also got issued a legal notice dated 2.08.2017 to the 1st respondent. As no action is being taken till today, present writ petition is filed.
Heard learned counsel for the petitioner and Sri P.V.V.Satyanarayana, learned Standing Counsel for respondents 2 to 5 and Sri B.Raj Krian, learned Standing Counsel for the 6th respondent.
Learned Standing Counsel appearing for respondents 2 to 5 submits that disciplinary proceedings are pending against the petitioner.
The same is disputed by the learned counsel for the petitioner.
It is to be seen that as petitioner already submitted representations dated 20.07.2016, 17.08.2016 and 30.06.2017 to the respondents, it is for the competent authority to consider the same and take action for payment of retirement benefits to the petitioner, in accordance with Rules.
In view of the same, the writ petition is disposed of directing competent authority to consider the representations of the petitioner dated 20.07.2016, 17.08.2016 and 30.06.2017, in accordance with Rules, within a period of two months from the date of receipt of a copy of this order and take action accordingly. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 19.09.2017 tk
