HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.35887 OF 2016 ORDER:
The petitioners claim to be the absolute owners and possessors of the house sites covered by Sy.No.85 (part) of Marripalem Revenue Village in the limits of the 2nd respondent Municipal Corporation, having purchased the same from the rightful owners under different registered sale deeds. They complain that for the purpose of laying road, the 2nd and 3rd respondents are insisting them to vacate their sites and that they have also made markings therein, without acquiring the same in accordance with law. Learned Standing Counsel appearing for the 2nd and 3rd respondents, on instructions, submits that the 2nd respondent Municipal Corporation does not have any plans of laying/widening the road and they are not aware about the alleged markings.
He further submits that the area where the petitioners' sites are stated to be located falls within the National Highway limits and, as on date, the National Highway authorities have not approached the 2nd respondent Corporation seeking acquisition of the subject sites. Recording the aforesaid submissions of the learned Standing Counsel appearing for the 2nd and 3rd respondents, the writ petition is closed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
