HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 1402 OF 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner.

The petitioner, in the instant writ petition, seeks the following prayer:

"For the reasons mentioned in the accompanying Affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction especially one in the nature of the Writ of Mandamus declaring the action of the Respondent No.1 in not deciding the IA filed in Complaint No.3090/2014/B2, by the petitioner for deciding preliminary issue of limitation as bad, illegal and further declare that the 1st respondent has no jurisdiction to look into the allegations made against the petitioner after 6 years and consequently direct the 1st respondent to decide IA filed by the Petitioner for deciding the limitation issue within a time frame and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioner fairly admits that no order has been passed by respondent No.1 so far in complaint No.3090/2014/B2 filed by respondent No.2 till this date. That being so, we do not find any reason to issue direction as prayed for. We are sure that respondent No.1, while dealing with the complaint filed by respondent No.2, shall also consider petitioner's prayer in the interim application. With these observations, the writ petition is dismissed.
