THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CIVIL REVISION PETITION No.5436 OF 2015 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India questioning the order, dated 07.08.2014, in Interlocutory Application No.865 of 2014 in Original Suit No.21 of 2014 passed by the II Additional District Judge, Karimnagar at Jagtial.

2. The above suit was filed by the respondent/plaintiff to recover a sum of Rs.16,00,000/-, which was paid by him to the petitioner/defendant towards sale consideration for purchase of 150 square yards in Sy.No.1372 with shops situated at Korutla Town and Mandal, Korutla, which was discovered to be void under Section 65 of the Indian Contract Act being a Government Shikam land apart from other reliefs.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the trial Court to dispose of the above suit at the earliest.

4. Having regard to the facts and circumstances of the case and taking into consideration the request made by the learned counsel for the petitioner, the Civil Revision Petition is disposed of directing the II Additional District Judge, Karimnagar at Jagtial to dispose of Original Suit No.21 of 2014, as early as possible, preferably within a period of one year from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this revision petition shall stand closed. There shall be no order as to costs.
