Heard Mr. O. Manoher Reddy for petitioner, learned Government Pleader for respondents 1 and 2 and Ms. B. Uma for respondent No.3. 2.

Petitioner challenges the notice of sale in EP.No.140/ 02-03. Petitioner challenges the conduct of sale by pointing out several illegalities and irregularities.

The undisputed fact is that against any decision, the second respondent takes, the petitioner can work out remedy by filing an appeal before the Cooperative Appellate Tribunal constituted under the A.P. Cooperative Societies Act. Since remedy of appeal is available against the impugned action and having regard to the urgency stated by petitioner and also illegalities pointed out in this behalf, the writ petition is disposed of by this order:

1. Respondents 2 and 3 are directed not to take any further action pursuant to notice impugned in the writ petition for a period of four (4) weeks from today.

2. Petitioner is given liberty to file an appeal before the appellate tribunal and if so advised, obtain appropriate orders in the meantime.
