Heard the learned counsel for the petitioners and the learned Government Pleader for R & B for Respondents. 2.
The Assistant Executive Engineer, R & B issued a notice under subsection (2) of Section 26 of the Control of National Highways (Land and Traffic) Act, 2002 on 6.12.2016. In response to the said notice, according to the petitioners, they submitted explanation on 12.12.2016. The only grievance of the petitioners in the present writ petition is that without considering the said explanation, the Respondent authorities are trying to demolish the houses of the petitioners herein. 3.
Since the same being the only complaint, this Court deems it appropriate to dispose of the present writ petition with a direction to the Respondents herein to consider the representation/explanation dated 12.12.2016 said to have been submitted by the petitioners herein, after giving opportunity of hearing to the petitioners herein and pass appropriate orders, in accordance with law. Till the said exercise attains finality, the interim order granted by this Court 25.5.2017 shall continue to remain operative.

The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
