HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CMA.No.19 of 2016 JUDGMENT :

When the matter is called on 03.02.2016, learned counsel for the respondents/plaintiffs stated that the suit itself has been withdrawn. But, the learned counsel for the appellant sought time for getting instructions and that the matter was posted to 05.02.2016. Again on 05.02.2016, the learned counsel for the appellant sought time.

Even today, when the matter is listed, learned counsel for the appellant has not disputed the statement made by the learned counsel for the respondents that the suit itself has been withdrawn. In view of the same, the cause in the CMA does not survive for further adjudication.

Accordingly, the CMA is dismissed as infructuous. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the CMA, shall stand closed.
