THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38929 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to call for the records in F.I.R. No.216 of 2016 of III Town Police Station, Karimnagar Police Commissionerate, Karimnagar District and quash the same as it is illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record. The main contention raised by the learned counsel for the petitioner is that even though the occurrence is alleged to have been taken place on 22-09-2016, the complaint was lodged on 27-09-2016 i.e., after five days and there is no proper explanation for the delay. Further, there is some dispute regarding financial transaction between the petitioner and the 4th respondent herein and the petitioner is also a patient.
Considering the said facts and circumstances, the police concerned are directed to complete the investigation into the crime without arresting the petitioner and file the final report, if any, in accordance with law. The petitioner is directed to execute a personal bond for a sum of Rs.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
