HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29453 OF 2018 ORDER:

The present writ petition came to be filed seeking to direct the 3rd respondent to conduct a proper enquiry in respect of issuance of Patta Rc.No.389/86A dated 10.08.1986 and cancel the same by restoring the petitioner ingress and egress.

The impugned order does not indicate any prior notice being issued to the petitioner or any enquiry was conducted before passing the same. In similar circumstances, this Court in W.P.No.18751 of 1998, filed by the 5th respondent herein, by its order dated 19.03.2004, has set aside the proceedings in R.C.No.1061/98/D, dated 27.5.1998 on the ground that the same was passed in violation of the principles of natural justice. As the petitioner has been making representations to the District Collector, Guntur, to conduct the enquiry in the subject matter after giving notice to the petitioner and as the subject matter of this writ petition is similar to the subject matter in W.P.No.18751 of 1998, it is just and proper to direct the 2nd respondent-District Collector to deal with the subject matter and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of eight to ten weeks from today, after giving the reasonable opportunity of hearing to the petitioner and all the concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
