Today, when the matter is taken up, on instructions, it is submitted by Sri N.Venkateshwarlu, learned Standing Counsel for the respondent-Authority, that the impugned notice can be treated as a show cause notice and it is open for the petitioner to submit an explanation to the same so as to enable the respondent-authority to pass final orders.
Recording the said statement, the Writ Petition is disposed of, by directing the impugned notice to be treated as a show cause notice, leaving it open for the petitioner to file appropriate explanation to the same, within a period of two weeks from the date of receipt of a copy of this Order and if any such explanation is submitted by the petitioner, within the time stipulated above, the respondents shall verify the same and pass final orders, strictly in accordance with law. Till the said exercise attains finality, there shall be status quo with regard to the construction shall be maintained.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
