The Court made the following :

ORDER:

This Writ Petition is filed for the following substantive relief:- " ... to issue an appropriate writ, order or direction, more particularly a writ in the nature of mandamus, declaring the action of the 1st respondent (1) in not supplying the petitioner with a copy of the report of the learned One Man Commission of Enquiry, headed by Sri Justice M. Jagannadha Rao (Retd.),

(2) in proceeding with the enquiry by the 3rd respondent without taking into account the definitive findings of the learned One Man Commission of Enquiry, headed by Justice M. Jagannadha Rao (Retd.), and (3) the action of the 2nd respondent in selectively implementing the TTD Board Resolution No.352, dated 14.8.2008, as being illegal and arbitrary, apart from being violative of the provisions of the Act 30 of 1987, and the principles of natural justice and fair play,

as well as the provisions of the Commission of Enquiries Act, 1952 and the constitutional mandate as enshrined in Chapter III of the Constitution of India, and consequently set aside the proceedings in G.O.Ms.No.1237 Rev. (Vig. IV Dept), dated 3.12.2009, through which the 3rd respondent was appointed as the Commissioner of Enquiry to conduct the disciplinary proceedings ..."

At the hearing, letter dated 29-9-2015, circulated by Mr. P. Hemachandra, learned Counsel for the petitioner, to the Registry, is placed before the Court, wherein he has informed that his client instructed him to withdraw the Writ Petition in view of certain subsequent developments.

Mr. K. Manoj, learned Counsel representing the Counsel for the petitioner, reiterated the contents of the said letter. In view of the above, the Writ Petition is dismissed as withdrawn.
