HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3684 of 2015 ORDER:

Alleging inaction on the part of the 3rd respondent in completing the investigation, though FIR No.149 of 2014 was registered on 24-09-2014, the petitioner filed the present writ petition. Learned Government Pleader has received instructions, which state that the Investigating Officer examined four witnesses and recorded their statements. The investigation revealed that there is a land dispute between the petitioner and respondents 4 to 10 and both the parties filed cases against each other. Hence, according to the 3rd respondent, the dispute is of civil in nature. It is further stated that the Sub-Divisional Police Officer, Nellore Rural, has accorded permission on 31-12-2012 for treating the case as civil in nature and that the Investigating Officer is taking steps to serve notice on the petitioner/complainant and file appropriate report before competent court.

In view of the above, as and when the report is served on the petitioner, he is at liberty to take appropriate steps before competent criminal court.

Accordingly, the writ petition is disposed of. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
