Sri P. Prabhakar, learned counsel for the respondent, submits that in view of the subsequent development, as per his instructions, the application has rendered infructuous.

This application was filed in 2009 and it last appeared before Court on 23.12.2011. Since then, petitioners never made any effort to take it before Court for hearing. With the passage of time and for the reasons stated by Sri P. Prabhakar, learned counsel for the respondent, the petitioners seem to have lost interest in prosecuting their application further and hence, no one is coming forward to work it out on merits. I am therefore constrained to dismiss the application for non-prosecution. Order accordingly.
