HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No. 27041 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer of the writ petition is as under:

" For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue any appropriate writ, order or direction more particularly in the nature of writ of mandamus, declaring the action of the police officials of the respondents in interfering with the civil disputes of the petitioner as illegal, arbitrary and violative of Articles 14 to 21 and 19 (1) (g) of Constitution of India and pass such other order or orders as this Court may deems fit and proper in the circumstances of the case."

The basic grievance of the petitioner in the writ petition is that the police officials of the respondents are interfering with the civil disputes of the petitioner. The learned Government Pleader for Home appearing for the respondents 1 to 3 filed counter-affidavit of 3rd respondent. In the said counter-affidavit, it is stated that a case in Crime No.878 of 2014 was registered under Section 420 IPC and Sections 4 and 5 of Prize Chits and Money Circulation Schemes Act, 1978 and investigation was taken up. The investigating officer examined the complainant and recorded his statement. During the course of investigation, no arrest was made. It is also specifically stated that the crime was registered against the petitioner and others prior to filing of the writ petition. On coming to know about the registration of the crime, the petitioner with a mala fide intention and with a view to divert the attention of the investigating agency, filed the present writ petition with false and baseless allegations. It is also stated in the counter-affidavit that the

respondents-police have acted in accordance with law for the purpose of curbing the unlawful activities of the petitioner. 4.

In the light of the specific statement made in the counter affidavit, this Court is of the opinion that no further orders are required in the writ petition.

Accordingly, the writ petition is closed. There shall be no order as to costs.
