THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.887 of 2011 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, has been preferred against the order of the learned Single Judge dated 11.10.2011 passed in W.P. No. 24447 of 2011. The writ petition was filed by the respondents-writ petitioners questioning the inaction of the 1st respondent therein, in not issuing transfer orders to the respondents-writ petitioners in pursuance to the Circular issued by the 1st respondent dated 6.6.2011, issued in lieu of G.O.Rt. No.455 dated 4.6.2011.
By the order under appeal, the learned Single Judge allowed the writ petition and directed the respondent-authorities to issue orders of transfer in accordance with the counselling that had taken place on 14.6.2011 for the employees working in the institutions in Zone VI within a period of three weeks from the date of the order. Aggrieved thereby, this appeal is preferred by the unofficial respondents in the writ petition.
W.A.M.P. No. 2036 of 2011 seeking stay of the order of the learned Single Judge was dismissed by order dated 5.11.2011 and the order of the learned Single Judge must, therefore, have been implemented.
Since the order under appeal was passed on 11.10.2011, more than five years ago, the cause in the writ appeal does not survive, and the writ appeal has become infructuous.
The writ appeal is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
