Voleti Sowjanya, Ranga Reddy Dist And 2 Others v. A.P.S.Rt.C., Rep By Its Md., Hyderabad
HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CIVIL REVISION PETITION No.3203 of 2015 ORDER:
Heard learned counsel for petitioners. None appears for respondent though notice to respondent served. 2.
This Revision is filed assailing the order dt.23-03-2015 of the Motor Accident Claims Tribunal-cum-XI Additional District Judge (FTC), Ranga Reddy District directing the petitioners, who are claimants in O.P.No.770 of 2013 filed under the Motor Vehicles Act to add the drivers of both vehicles involved in the accident, owner and insurer of auto, which is also involved in the accident. 3.
Learned counsel for petitioners contends that subsequent to passing of the order on 23-03-2015, petitioners have added the driver of the bus owned by the respondent in I.A.No.774 of 2015 and that the driver, owner and insurer of the auto in question are not necessary parties because no claim is made against owner of the auto which was also involved in the accident, in which the husband of 1st petitioner was traveling.
4.
The O.P. is of the year 2013 and the driver of the bus owned by the respondent has already been impleaded.
5.
Since there is no claim against the owner of the auto made by the petitioners, there is no necessity to implead the owner, driver and insurer of the auto in question which was also involved in the accident.
MSR,J C.R.P.No.3203 of 2015 6.
Accordingly, the Civil Revision Petition is allowed and the order dt.23-03-2015 of the Motor Accident Claims Tribunal-cum-XI Additional District Judge (FTC), Ranga Reddy District, insofar as it directed addition of the driver, owner and insurer of the auto in question, is set aside. No costs.
7.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
