The case of the petitioner that he applied for the post of A.R. Constable in pursuance to the notification issued by the 2nd respondent and the petitioner was provisionally selected. Thereafter, the petitioner was issued show-cause notice dated 20-05-2017 stating that petitioner though possessed only LMV licence, he mentioned as possessing HMV licence. The petitioner submitted explanation on 22-05-2017. As no orders are passed, aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that in check-list slip, the petitioner has clearly mentioned that in column No.23 shown possessing LMV licence only. Without considering the same, the present show-cause notice is issued. He submits that the petitioner mentioned as Transport in the application while mentioning driving licence and following the same, the petitioner has filled-up application and the petitioner has not suppressed any fact. In fact the petitioner has enclosed LMV licence only along with the application and the petitioner is not claiming marks in HMV licence category.

It is to be seen that show-cause notice was also issued and the petitioner filed explanation stating above

facts, it is for the competent authority to take above facts into consideration before passing orders.

In view of the same, the competent authority is directed to consider the above facts and circumstances of the case and pass orders within two weeks from the date of receipt of a copy of this order and thereafter take action in accordance with law.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 21-08-2017 Nvl
