HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:28280 OF 2013 ORDER:

1. This writ petition is filed challenging the action of respondent No.2 in seizing and retaining the vehicle of the petitioner viz., DCM Eicher (1110) bearing No.MH-04-EB-1445.

2. It is the case of the petitioner that his vehicle was stolen and used for transporting teak wood and in that connection, the said vehicle was seized. The petitioner is no way concerned with the offence committed by the accused under the Forest Act.

3. When this matter has been taken up, it is brought to the notice of this Court that the confiscation proceedings have already been over in respect of the vehicle in question and thereby, the cause in this writ petition does not survive for adjudication.

4. Recording the above submission, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. If the petitioner is aggrieved over the confiscation proceedings, he is at liberty to avail the remedy, if he is so advised, before the appropriate forum.
