Kongara Purnachandrarao, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.NO.6165 OF 2017
O R D E R
Heard the learned counsel for the petitioners, learned Government Pleader for Land Acquisition for respondents 1 to 5 and Government Pleader for Irrigation for respondent No.6.
Obviously, the grievance of the petitioners in the present writ petition is with regard to quantum of compensation fixed by the Land Acquisition Officer under the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013(Act 30 of 2013).
When the matter is taken up, the learned Government Pleader for Land Acquisition raised preliminary objection with regard to maintainability of writ petition stating that petitioners herein have an effective alternative remedy under Section 64 of Act 30 of 2013 and without availing the same, the present writ petition is filed directly before this court.
In view of the availability of alternative remedy, this court is not inclined to entertain the writ petition. However, it is open for the petitioners to approach the authority under the provisions of Section 64 of Act 30 of 2013.
With the above observation, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
