HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is aggrieved by the placements assigned in the final seniority list for the post of Bio Chemist (G) prepared by the Director of Medical Education vide proceedings dated 24.08.2018. Against the said seniority list, remedy of appeal is available to an aggrieved employee. Without availing such remedy, this writ petition is filed.

Having regard to the requirement of preferring an appeal as provided in Rule 26 of Telangana State and Subordinate Service Rules, 1996, learned counsel for petitioner seeks leave of the Court to file an appeal against change in seniority position in the final seniority list.

In view of the provision in Rule 26 of General Rules, the leave as sought for is granted. Writ petition is disposed of accordingly. It is needless to observe that as and when appeal is preferred within the fixed time, the appellate authority shall consider the same objectively, if necessary by putting on notice persons who are likely to be affected on the claim of petitioner, and pass appropriate orders within a period of two months from the date of receipt of copy of this order. Pending miscellaneous petitions shall stand closed.
