THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.14896 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking to set aside the impugned e-auction sale notice, dated 27.04.2015, fixing date of auction of the property in question as 30.05.2015 under Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

When the matter is called, learned counsel for respondent No.1 placed on record a memo stating that the auction could not be held on 30.05.2015 in view of the interim orders passed by this Court, as such, respondent No.1 - Bank is withdrawing the sale notice, dated 27.04.2015, and hence, the Writ Petition be dismissed as infructuous by reserving the right of respondent No.1 to take further steps in accordance with law for issuing fresh sale notice. From a perusal of the memo filed on behalf of respondent No.1, it is clear that the impugned notice is not being acted upon and respondent No.1 seeks liberty to take further steps for issuing fresh notice.

In that view of the matter, granting liberty to respondent No.1 to take further steps under the aforesaid Act for issuing fresh notice in accordance with law, the Writ Petition is closed.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No costs.
