The present Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner with the following prayer:

".....to declare the inaction of the 2nd respondent in the matter of treating the Post Doctoral study period from 15-09-2014 to 14-09-2015 as On-Duty with full pay of monthly salary along with allowances and attendant benefits in pursuance of the UGC guidelines/directives prescribed vide Letter No.F.1-/2012(PS) Dt. 7th June, 2013 and being followed for fellow UGC Raman Post Doctoral scholars in other Universities in the State; payment of travelling expenses from India (Andhra University) to USA (Bowling Green State University) and back as per UGC, New Delhi, (Selection) Letter No. F.No.5- 1/2013(IC), Dt. April 23 2014; and according promotion from the position of Assistant Professor (Stage 2) to Assistant Professor (Stage 3) as per the norms of the Career Advancement Scheme (CAS) being followed by Andhra University and as committed by University authorities vide proceedings No.

SII(7)/OOD/2013-14 of the Vice-Chancellor Dt. 24-12-2015, in spite of the settled protocol and guidelines of UGC and law as illegal, arbitrary, discriminatory and against the principles of natural justice."

In substance, the grievance of the petitioner is that though he is eligible to be promoted to Grade 3 Assistant Professor, the same is not granted.

In para No.8 of the counter affidavit filed on behalf of the 2nd respondent, it is stated that the petitioner's case has been reviewed and that the period of Post Doctoral Fellowship has been treated as study leave vide proceedings of the Vice Chancellor No.S.II(7)/OOD/2013-14, dated 24.12.2015, and the annual increments in this respect have been sanctioned to the petitioner. It is further stated that the request of the petitioner with respect to his promotion, file has been submitted and it is under process. 4.

In view of this submission, learned counsel for the petitioner submits that time may be fixed for undertaking exercise of granting promotion to the petitioner.

The Writ Petition is disposed of directing the 2nd respondent to comply with the undertaking given in para No.8 of the counter affidavit, as expeditiously as possible preferably within a period of three (03) weeks from the date of receipt of a copy of this order.
