THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3611 OF 2016 ORDER:

This petition is filed by the petitioner-A11 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.61 of 2015 on the file of I Town Police Station, Tenali, Guntur District, registered for the offence punishable under Sections 468, 471, 420 and 447 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that A1 to A4 created fake documents in respect of the property of the complainant in order to grab the same. The fake documents were prepared by document writers-A12, A13, for which A14 to 19 are the witnesses. It is alleged that the petitioner, who is the Sub-Registrar, registered those fake documents. It is the case of the petitioner that the entire transaction was done by A1 to A4 and the petitioner being the Sub-Registrar of Cherukupalli registered the documents whatever presented for registration and he has not committed any offence. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner. However, if any charge sheet is filed against the petitioner, he is at liberty to challenge the same before the appropriate Court.
