HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.9998 of 2014 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioners/A1 to A4 seek to quash the proceedings in Cr.No.227 of 2014 of Kamareddy P.S.

2) The defacto complainant is the daughter-in-law of A1. A2 to A4 are nephews of A1. The allegation is that after the death of husband of defacto complainant due to kidney problem, A1 with the help of other accused necked out the complainant from the matrimonial home. Hence the complaint.

3) Denying the allegations, learned counsel for petitioners submitted that a false complaint was given to extract amounts from A1. He submitted that the complainant hardly lived 4 or 5 months with her son and when her son fell ill the complainant left his company and started living with her parents. She totally neglected her husband but A1 by mortgaging a plot and spending her own amounts met the medical expenditure of her son. She now filed a false complaint to harass the accused to extract amounts from them. It is also submitted that A1 is an aged lady and in fact she donated kidney to her son. He thus prayed to allow the petition.

4) Having regard to the allegations and counter allegations made by the parties, this Court is of the considered view that investigation shall be proceeded with to exhume the truth or liability of complaint allegations. Hence, investigation shall be continued to its logical end. However, the police of Kamareddy PS are directed not to arrest the petitioners/A1 to A4 during the course of investigation. The petitioners shall cooperate with the Investigating Agency for smooth completion of investigation.

5) This Criminal Petition is accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
