The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Sessions Case No.12 of 2012 on the file of Special Judge for Trial of offences under SC & ST (POA) Act, Nellore, arising out of PRC. No.38 of 2012 in Crime No.26 of 2012 on the file of Station House Officer, II Town Police Station, Kavali, for the offences punishable under Sections 448, 323, 506 read with 34 IPC.

The 2nd respondent/de facto complainant and his counsel are present. The petitioners/accused and their counsel are also present.

Heard both sides and perused the record.

On the report of the 2nd respondent/de facto complainant, the Station House Officer, Kavali II Town Police Station, Nellore, registered a case in Cr.No.26 of against the petitioners/accused for the offences alleged, and after completion

of investigation, filed the charge sheet.

It is submitted by both parties that at the intervention of the elders, the parties have amicably settled their disputes concerning to present case and hence compromise may be recorded and criminal proceedings in the above case may be quashed. Having regard to the above submission and considering the fact that the parties have amicably settled the disputes among themselves out of Court and no useful purpose will be served even if the parties are driven to the trial as they compromised, and following the decision reported in Gian Singh v. State of Punjab and another[1] the criminal miscellaneous petition is allowed and compromise is recorded, and consequently, proceedings in Sessions Case No.12 of 2012 on the file of Special Judge for Trial of offences under SC & ST (POA) Act, Nellore, arising out of PRC.No.38 of 2012 in Crime No.26 of 2012 on the file of Station House Officer, II Town Police Station, Kavali, against the petitioners/A1, A3 to A5 are hereby quashed.

The Crl.P.MP.No.3507 of 2015 and Crl.P.No.1431 of 2015 are accordingly allowed.

Pending miscellaneous applications, if any, shall stand closed in consequence.
