THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2367 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 to A-4 in Crime No.398 of 2015 of Siddipet I Town Police Station, Medak District registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act. Heard the learned counsel for the petitioners/A-1 to A-4 and the learned Public Prosecutor and perused the material available on record.

Admittedly, a case was registered against the petitioners basing on the complaint given by the 2nd respondent/de facto complainant for the alleged offences. The truth or otherwise of the allegations made in the complaint will be ascertained only after due investigation and the same cannot be decided at this stage. Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners/A-1 to A-4. However, in view of the submission of the learned counsel for the petitioners that the petitioners/accused 1 to 4 are apprehending of their arrest in view of pendency of the above crime, the Siddipet I Town Police Station, Medak District are directed to complete investigation without arresting the petitioners/ A-1 to A-4 and file the final report in accordance with law. The petitioner/accused 1 to 4 are directed to appear before the Investigating Agency as and when their presence is required and cooperate with the Investigating Agency.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
