THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12292 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/A4 and A5 seeking anticipatory bail in the event of their arrest in connection with Crime No.105 of 2023 of Mokila Police Station, Cyberabad, registered for the offence punishable under Section 363 of IPC.

Heard learned counsel for the petitioners/A4 and A5, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The case of prosecution is that there was litigation between A1 and the de facto complainant with regard to plot and these petitioners offered to help the accused in the said litigation. The de facto complainant was abducted by A1 and A2 and was later released. During the course of investigation, it was found that the petitioners offered to help A1 and A2 to settle the issues. 4.

Learned counsel appearing for the petitioners would submit that except stating that these petitioners offered to help A1 to purchase the disputed property, there is no allegation of abduction of the victim by the petitioners.

Keeping in view that these petitioners are not involved in the actual abduction of the victim, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners/A4 and A5 subject to the following conditions:

1) The petitioners/A4 and A5 are directed to surrender before the Station House Officer, Mokila Police Station, Cyberabad, within a period of seven days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A4 and A5 on bail, on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A4 and A5 shall appear before the concerned Station House Officer, on every Monday, for a period of four (4) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.

3) The petitioners/A4 and A5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
