ORDER
Heard learned counsel on either side.
This writ petition is filed seeking to declare the action of the 3rd respondent in terminating the petitioner from duties vide order dated 23.05.2014, as arbitrary and illegal. The petitioner was appointed as Field Assistant, K.Sivaram Gram Panchayat, Amarapuram Mandal, Anantapurm District. While so, the 3rd respondent passed final order terminating the petitioner from the service.
Learned counsel appearing for the petitioner submits that without issuing any show cause notice and without affording any opportunity to submit his version, the petitioner was terminated and therefore, the 3rd respondent has violated the principles of natural justice.
On the other hand, learned Standing Counsel appearing for the respondents submits that show cause notice was issued to the petitioner, for which, he submitted his explanation admitting the charges and thereafter, the impugned order was passed by the 3rd respondent.
In any event, against the order impugned in this
writ petition, the petitioner preferred an appeal and the same is pending before the 2nd respondent.
Therefore, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order by affording an opportunity of hearing to the petitioner. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
