HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22240 of 2005 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner has retired from service and subsequently it was informed by the learned Standing Counsel for the respondent - Company that the petitioner has expired during the pendency of the writ petition.

A perusal of the record discloses that the petitioner has filed this writ petition seeking promotion to the post of M-I Grade while he was working as Personnel Manager in the respondents Company. Since the relief sought by the petitioner cannot be granted at this point of time, this Court is of the considered view that the cause in the writ petition does not survive for adjudication. More-so, when the counsel for the petitioner could not take steps to bring the legal representatives of the deceased petitioner on record.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
