HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 41167 OF 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

When once civil suit is filed in O.S.No.697 of 2013 on the file of XI Addl. Chief Judge, City Civil Court, Hyderabad for declaration of title, the petitioners again filing this writ petition, for the same relief does not arise. It is always open for the petitioners to seek appropriate interim orders in the aforesaid suit. Petitioners cannot simultaneously pursue the suit and writ petition. In view of the same, I do not see any reason to entertain the writ petition and accordingly, this writ petition is dismissed granting liberty to the petitioners to obtain appropriate orders in the civil suit pending before the Civil Court. Interim order granted on 01.12.2016, which was extended from time to time shall stands vacated.

There shall be no order as to costs. As a sequel to the dismissal of this petition, miscellaneous petitions, if any, pending shall stand dismissed.
