HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8065 OF 2010 ORDER:

The grievance as made by the petitioner is that in spite of the petitioner being eligible for grant of bank loan under Kolleru Special Package Scheme (in short "the Scheme"), the application made by the petitioner was rejected on the grounds that the petitioner was aged about 63 years and petitioner's name was not found in the survey list which was approved earlier for sanction of financial assistance under the Scheme. It is the specific contention of the petitioner that in the list prepared by the respondents for 2006-2007 and 2007-2008 there were senior citizens who crossed 85 years, were also sanctioned loan, thus, there was discrimination in considering the petitioner's case. Counter affidavits have been filed by the 1st and 2nd respondents.

It is the case of the respondents that there is no fish pond in the land claimed by the petitioner, which is situated in Agadallanka village of Bhimadolu Mandal, West Godavari District, and thus petitioner is not eligible to be included in the list of eligible candidates for sanction of financial assistance under the Scheme. The allegations that the persons who are aged 85 years and two or three members in the families who have pink ration cards were also sanctioned loans under the Scheme for the purpose of buying a buffalo for alternative livelihood under the Scheme, have been specifically denied. There is no reply affidavit filed by the petitioner to the counter affidavits. In that view of the matter, the grant or non-grant of loan is being dependent only on the satisfaction of the authorities with regard to the eligibility criteria and there being no illegality in not granting loan, the writ petition fails and accordingly the same is liable to be

dismissed.

Writ Petition is dismissed accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall also stand closed.
