HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29507 of 2018 ORDER:

The present Writ Petition came to be filed seeking issuance of a writ of mandamus declaring the inaction of the respondents 2 to 4 in entering the name of the petitioner in pattadar column in respect of the land admeasuring Ac.3-07 guntas in Survey No.9/1/E, situated at Garimellapadu village, Chunchupally Mandal, Bhadradri Kothagudem District insite of the representations, as illegal and improper. 2) The averments in the affidavit filed in support of the Writ Petition show that the petitioner is the General Power of Attorney holder of his father A.Seshagiri Rao. By virtue of a Will dated 06.03.1982, executed by Anne Suryanarayana, his father acquired title and right over the subject land. It is said that though in respect of other lands, the authorities have entered his name in the passbook, but in respect of the land of Ac.3-07 gts.

, in Sy.No.9/1/E, Garimellapadu village, Chunchupally Mandal, Bhadradri Kothagudem District, the name of the petitioner is not reflected. The inaction on the part of the Tahasildar, inspite of his repeated representations, lead to filing of the present Writ Petition.

3) Learned counsel for the petitioner would submit that inspite of repeated requests for incorporating the name of the petitioner in the pattadar column, no entries are made till date.

4) On the other hand, learned Government Pleader would submit that there appears to be some dispute with regard to right of the petitioner over the property and even as per the averments in the affidavit, by virtue of a Will, they are claiming to acquire the right over the property.

5) Be that as it may, without going into the merits of the case, the Writ Petition is disposed of directing the petitioner to submit a representation to the Tahasildar making a request as sought for in the Writ Petition, in which event the 4th respondent shall deal with the same in accordance with law, if he is otherwise competent to do so.

6) There shall be no order as to costs. Miscellaneous Petitions, pending if any in this Writ Petition shall stand closed. ___________________ C. PRAVEEN KUMAR, J Date: 27.08.2018 GM
